Insurance Claim on Cobra

Post by mooreken »

As this is a different phase of my collision I have started a new thread.
Using the State Farm app. I noticed that it indicated that an estimate was written, but when I checked it was showing only a zero balance minus my deductible. So, I called the agent assigned to me, and after a bit of time on hold she told me that the claim has been transferred to another department that handles total losses.
I really didn't want to hear that. There are lots of scenarios with this path of settlement, so I won't list all the things that can go wrong or right at this time.
I was told by the old agent that she had put in a request to have the new agent call me with a status on the claim, but no call came today.
As the estimate that I had made up is only 1/2 of the value that I insured for I still have some leverage in not having the car totaled.
Totaling a car caused lots of things to come into play. I'll go into that if I need to...Still hoping for getting things to go my way. :naughty:

Ken,
I hope this works out OK for you. I'd hate to see State Farm earn the "fickle finger of fate" award :angry-cussingblack:

And the story builds.
The passenger in the pickup that was hit has now hired Morgan and Morgan, I assume due to the driver of the offending car not having insurance, and I now have a certified letter indicating they want to go after me for damages.
I passed it along to State Farm.

Well...not a scam per say. But it is sleazy, Morgan and Morgan was just a fishing effort spamming out lawyer letters just hoping that something will stick. St. Farm gave them a call and that's all handled. I have lost a lot of respect for Morgan and Morgan. To even make an attempt to accuse an innocent person just to give their client false hope is why all those lawyer jokes ring true.

As far as the claim I might be making progress. I finally got to an adjuster that at least knows what a cobra is. I've decided to push for them accepting the estimate I provided and I will sign a waiver that I will not go after more money if I find additional damage. This will keep the car from being a total so I have a clean title, and the coverage will continue as it is now. The estimate is less than have of the agreed price coverage and much less than half of their appraised value, so this keeps it out of the total loss metrics. Once a car totals and I buy it back the insurance companies will not cover collision anymore. They have paid for the car once and will not pay again. My expectations are that sometime this week I will get an estimate either from them or they will accept mine. So long as it is near the figure of my estimate, I can make it work.

I heard from State Farm and they accepted my estimate.
This is the best option. They were firm that if totaled I would end up with a total/salvage title. That and once totaled State Farm would not insure it again as they paid once and will not pay twice.
This way the title stays with me and the insurance continues as it was before.
Now I am waiting for the check and will start ordering parts. If I could only order a bit of motivation and energy. 😂

Ken,

Woohoo!

Another tooth pulled...

Possibly you can make it better than it was?
